Terms of Service

1. Agreement and eligibility

These Terms of Service govern access to and use of BrandLift websites, applications, website-analysis tools, website-building services, managed hosting, and communications tools. By using the services, you agree to these terms and confirm that you are authorized to act for the business or account you connect.

2. BrandLift services

BrandLift may analyze public websites, prepare diagnostic scores and recommendations, generate website content or designs, support website deployment and hosting, and help authorized businesses manage customer communications. Features, availability, pricing, and service scope may vary by plan or written order.

3. Connected accounts and permissions

You may connect third-party accounts, including hosting providers and Meta business assets. You represent that you have authority to grant the requested access. BrandLift uses connected-account permissions only to provide the requested functionality. You may revoke third-party access through the applicable provider or contact BrandLift for assistance.

4. Agent-assisted communications

BrandLift can monitor authorized business communication channels, classify inbound messages, prepare responses, send permitted low-risk responses under the autonomy settings you select, schedule follow-ups, and escalate messages for human review. You can require approval, take over a conversation, or disable autonomous sending. You remain responsible for connected-account authority, recipient eligibility, required consent, communication policies, and applicable law.

5. Customer content

You retain ownership of content and business materials you provide. You grant BrandLift a limited right to process that material to operate, secure, support, and improve the services you request. You must not provide content that infringes another party's rights or violates law.

6. Generated output and review

AI-generated communications, drafts, analyses, scores, designs, and recommendations may contain errors. BrandLift uses confidence thresholds, action limits, escalation rules, and audit records to reduce risk, but these controls do not replace appropriate human oversight. BrandLift does not guarantee search rankings, revenue, leads, uninterrupted availability, or a particular business result.

7. Acceptable use

You may not use BrandLift to send spam, impersonate another person or business, bypass platform restrictions, collect data unlawfully, distribute malicious code, interfere with the services, or violate third-party terms. BrandLift may restrict access needed to prevent abuse or protect users and systems.

8. Fees, suspension, and termination

Paid services are governed by the pricing and payment terms shown at checkout or in an applicable written order. You may stop using the services at any time. BrandLift may suspend or terminate access for nonpayment, material breach, unlawful activity, or security risk.

For the approved website offer shown at checkout, managed hosting is $99 per month equivalent with a mandatory 12-month term, paid in full upfront ($1,188). The website build is included free. The prepaid service is non-refundable, except where required by law. Checkout records your acceptance before redirecting to Stripe.

A qualifying $99 domain payment for that same website is credited once against the first annual hosting payment, reducing the amount due to $1,089. Refunded purchases do not qualify. The credit does not apply to the $749 website-files-only option or renewals. Website-files delivery includes your approved website, assets and deployment instructions, available through your private client portal within 24 hours after confirmed payment. You arrange hosting, domain and maintenance separately.

When hosting includes a new domain, select an eligible standard name during checkout. Selection is not a separate purchase or reservation. Registration and connection follow payment and remain subject to registrar confirmation. The first year is included; future domain renewals require separate arrangements. Paid hosting checkout authorizes setup and publication of the exact website revision you approved. Your portal reports the site as live only after publication is verified. Completing checkout does not authorize an unapproved future website revision to go live.

9. Disclaimers and limitation of liability

To the extent permitted by law, the services are provided on an “as available” basis without implied warranties. BrandLift Industries LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities. Any direct liability is limited to amounts paid for the affected service during the preceding twelve months.

10. Governing law and changes

These terms are governed by Arizona law, without regard to conflict-of-law principles. BrandLift may update these terms by publishing a revised version and changing the effective date. Continued use after an update constitutes acceptance of the revised terms.
